YAKUZA MOB BOSS RESPONSIBLE FOR UNDERLINGS ACTS

The Supreme Court in November, 2004 for the first time held the head of a
yakuza criminal gang liable for damages for a crime he was not directly involved
in, but carried out by underlings in his gang. The Supreme Court ordered
him to pay 88 million yen in damages for the mistaken murder of a police
officer (they thought they were shooting a criminal rival). The Court actually
referred to provisions in the Civil Code holding the employer of a business
organization liable for the activities of an employee working on a objective
of the business. Likewise, in April the Japanese parliament also passed legislation
that specifically held the heads of criminal gangs liable for the victims
of crimes carried out by the members of his gang.
