NO INJUNCTION ON MASSIVE CORPORATE CAPITAL INCREASE
KEYWORDS: CORPORATE LAW, MAJOR SHAREHOLDER, CAPITAL INCREASE

The Tokyo District Court refused to grant an injunction sought by CSK corporation against BellSystem24. CSK, the company’s largest shareholder had complained that a massive private share placement by BellSystem24, larger than existing total capital, would dilute its status as the lead shareholder. The court found however the business needs justified the financing.
