COMMERCIAL CODE OF JAPAN


 


Article 4. The Meaning of Merchant

1. For the purposes of this Commercial Code, [Merchant],  means a person who, in his own name, carries out commercial acts as a business.
2. A person who sells goods through a store or similar facilities, or a person operating a mining business shall be regarded as a merchant even for those not carrying out commercial acts as a business. The same shall be the case for the companies of Article 52, paragraph 2.
