Article 10 (Delegation of Duties)

The matters relating to the enforcement of the Law (limited to the provisions of Chapter 5 and Article 67 of the Law) under which the Minister of Finance or the Minister of Finance and the Minister having jurisdiction over the relevant industry will permit The Bank of Japan to handle, based on the provisions of Article 69, Paragraph 1 of the Law, shall be those matters listed in the following. Provided, however, that when the Minister of Finance, or the Minister of Finance and the Minister having jurisdiction over the relevant industry deem it necessary, as determined by Ministry of Finance Ordinance or Competent Ministry Ordinance, this shall not prevent such Ministers from handling these matters themselves:

(1) The acceptance of reports based on the provisions of Article 26, Paragraph 3 of the Law, and Article 29 of the Law.

(2) The acceptance of the notification based on the provisions of Article 27, Paragraph 1 and Article 30, Paragraph 1 of the Law.

(3) Notice of shortening of the period or other matters relating to the shortening of the period based on the provisions of Article 26, Paragraph 4 of the Law, Article 29, Paragraph 2 & 4 of the Law and Article 30, Paragraphs 2 & 4, of the Law, as determined by the Minister of Finance and the Minister having jurisdiction over the relevant industry;

(4) The delivery of documents describing the extension of the period based on the provisions of Article 27, Paragraphs 3 & 6 of the Law, and Article 30, Paragraphs 3 and 6 of the Law.

(5) The delivery of documents in which are denoted the recommendations based on the provisions of Article 27, Paragraph 5 of the Law and Article 30, Paragraph 5 of the Law;

(6) The acceptance of notices relating to acquiescence based on the provisions of Article 27, Paragraph 7 of the Law (including those situations which apply mutatis mutandis in Article 30, Paragraph 7 of the Law);

(7) The delivery of documents describing the contents of orders based on the provisions of Article 27, Paragraph 10 of the Law (including those situations which apply mutatis mutandis in Article 30, Paragraph 7);

(8) Cancellation notices based on the provisions of Article 27, Paragraph 11 of the Law (including those situations which apply mutatis mutandis in Article 30, Paragraph 7 of the Law);

(9) The preparation of records based on the provisions of Article 3, Paragraph 8 of the Law (including those situations where such provisions apply mutatis mutandis to Paragraph 12 of the same Article, and Article 5, Paragraphs 6 and 8 of the Law);

(10) The acceptance of reports based on the provisions of the previous Article;

(11) Matters incidental to the matters listed in each of the preceding items.
