Article 52 (Notification, etc. of the Establishment of a Liaison Office of a Foreign Bank)

In those situations where a foreign bank is going to establish a liaison office or other such facilities (including those situations where it is going to do the said business at an office or other facilities which were established based on other objectives) in Japan in order to conduct business listed in the following, it must in advance notify the Minister of Finance of the particulars of the said business, the location of the said facilities and such other matters as determined by the Ordinance of the Ministry of Finance.

(1) The collection or the provision of information concerning the business of banks.

(2) Other business which is related to the business of banks.

2. The Minister of Finance, when he deems it necessary for the interest of the public, can request the foreign bank to file reports or data concerning the businesses listed in each of the Items of the previous Paragraph which is conducted at the facilities provided for in the same Paragraph.

3. When a foreign bank has stopped using the facilities of Paragraph 1, which had been established, which had been established, discontinued the businesses listed in any of the Items of the same Paragraph which it had been conducting at the said facilities, or otherwise makes a change in the items reported in the notice based on the provisions of the same Paragraph, it must without delay make a notification as to the particulars thereof, to the Minister of Finance.
