Article 46 (Opinions, etc. of the Minister of Finance in Liquidation Procedures, etc.)
The court, in procedures for liquidation, bankruptcy procedures, composition procedures, reorganization procedures, etc. of a bank, can request the Minister of Finance for an opinion or can request research or an examination.
2. The Minister of Finance, when he deems it so necessary, in the procedures of the provisions of the previous Paragraph, can state his opinion to the court.
3. The provisions of Article 25, Paragraph 1, Paragraph 3 and Paragraph 4 shall apply mutatis mutandis concerning those situations where, based on the provisions of Paragraph 1, the Minister of Finance is requested by a court to make an examination or research.
